What you can and cannot do with FEP Search Group website.
  1. Introduction.

This page contains the Terms and Conditions governing your use of the FEP Search Group Web Site and its services. Please read this page carefully. The following Terms and Conditions form a binding Agreement between you and FEP Search Group. Your use of the FEP Search Group Web Site indicates your acceptance of these Terms and Conditions. If you do not accept these Terms and Conditions, you may not use the FEP Search Group Web Site.

FEP Search Group may revise the Agreement at any time by updating this page. Changes to the Agreement will also be binding on you. Any use of the FEP Search Group Web Site or its services will be considered acceptance by you of the then-current Terms and Conditions. If at any time you find the Agreement unacceptable, you should no longer use FEP Search Group.

The use of FEP Search Group and its services is a privilege. FEP Search Group reserves the right to suspend that privilege on an individual basis for any reason at any time, in its sole discretion.     1. Definitions.

For the purposes of this Agreement, the following definitions apply: “FEP Search Group Web Site” or the “Site” includes the FEP Search Group Web Site in its entirety. “Content” includes all Text, Graphics, Design and Programming used on the FEP Search Group. “Text” includes all text on every page of the FEP Search Group Web Site, whether editorial, navigational, or instructional. “Graphics” includes all logos, buttons, and other graphical elements on the FEP Search Group Web Site, with the exception of paid advertising banners. “Design” includes the color combinations and the page layout of the FEP Search Group Web Site. “Programming” includes both client-side code (HTML, JavaScript, etc.) and server-side code (Active Server Pages, JSP, VBScript, databases, etc.) used on the FEP Search Group Web Site. “Document” refers to any posting to the FEP Search Group Web Site, whether job or resume. “User” refers to any individual who uses any aspect of the FEP Search Group Web Site or its services.

  1. Intellectual Property Rights.

All Content on the Site and any published e-newsletters is the sole property of Sterling-Hoffman Executive Search, and is protected by Canadian copyright and international treaties. FEP Search Group authorizes you to view and download a single copy of the material on the FEP Search Group Web Site solely for your personal, noncommercial use. You may not reproduce, modify, display, sell, or distribute the Content, or use it in any other way for public or commercial purpose. This includes copying or adapting the HTML code used to generate Web pages on Sterling-Hoffman Executive Search. “Sterling-Hoffman Executive Search,” the FEP Search Group design logo and certain other names or logos are service marks or trademarks of Sterling-Hoffman IM Inc., and all related product and service names, design marks and slogans are the service marks or trademarks of Sterling-Hoffman Executive Search, Inc. In addition, the “look” and “feel” of the Site (including color combinations, button shapes, layout, design and all other graphical elements) are also protected by Sterling IM’s trademarks, service marks and copyrights. All other product and service marks contained on the Site are the trademarks of their respective owners.

  1. Acceptable Use of the Site.

The FEP Search Group Web Site and its services are intended for individuals seeking employment and for employers or recruiters seeking candidates for employment. The FEP Search Group Web Site may be used only for lawful purposes within this stated context of Sterling-Hoffman Executive Search’s intended and acceptable use. FEP Search Group is the sole interpreter of its intended and acceptable use. As one of the conditions of your use of the FEP Search GroupWeb Site, you represent, warrant and agree that you will not use (or plan, encourage or help others to use) the FEP Search Group Web Site for any purpose or in any manner that is prohibited by these Terms and Conditions or by applicable law. It is your responsibility to ensure that your use of the FEP Search Group Web Site complies with these Terms and Conditions. In particular, acceptance of these Terms and Conditions indicates agreement with and submission to the following rules for posting, conduct and security on Sterling-Hoffman Executive Search.

Violations of system or network security may result in civil or criminal liability.

Violation of these Security Rules may result in civil or criminal liability. FEP Search Group will investigate occurrences, which may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.

  1. Disclaimers and Limitations on Sterling Life Science’s Liability.

FEP Search Group assumes no responsibility for the activities or conduct of Users. Nothing on the Site shall be considered an endorsement, representation or warranty with respect to any User or third party, whether in regards to its web site, products, services, hiring, employment or recruiting practices, or otherwise.

FEP Search Group makes no representations or guarantees regarding the truthfulness, accuracy, completeness, timeliness or reliability of any articles posted, or of any other form of communication.

FEP Search Group makes no representations or guarantees regarding the Content of the Site, including, but not limited to, broken links, inaccuracies or typographical errors.

FEP Search Group makes no representations or guarantees regarding the accuracy, reliability, completeness or timeliness of the Site or its Content. By accepting these Terms and Conditions, you agree to use the Site at your own risk. FEP Search Group may change the Site at any time.

IF YOUR USE OF THE WEB SITE OR THE MATERIAL RESULTS IN THE NEED FOR SERVICING OR REPLACING EQUIPMENT OR DATA, FEP Search Group IS NOT RESPONSIBLE FOR THOSE COSTS.

YOU ASSUME ALL RESPONSIBILITY AND RISK FOR YOUR USE OF THIS SITE AND THE INTERNET GENERALLY. IN NO EVENT SHALL Sterling-Hoffman Executive SearchOR ADVERTISERS, BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTUNITY, OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR ACCESS TO, OR THE INABILITY TO USE OR ACCESS, THE FEP Search Group WEB SITE AND THE CONTENT AND/OR ANY DOCUMENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT FEP Search Group IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OR LIABILITY FOR CONSDEQUENTIAL OR INCIDENTAL DAMAGES, THE LIMITATIONS SET FORTH IN THE PRECEDING PARAGRAPH MAY NOT APPLY TO YOU. FEP Search Group is not responsible for the content of linked third-party sites and does not make any representations regarding the content or accuracy of materials on such third-party Web sites. If you decide to access linked third-party Web sites, you do so at your own risk.

  1. Indemnity.

You agree to defend, indemnify, and hold harmless Sterling-Hoffman Executive Search, it’s officers, directors, employees and agents, from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Site, the Content, any Document posted by you, or your breach of these Terms and Conditions. FEP Search Group shall provide notice to you promptly of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.

  1. User Information.

FEP Search Group may use the information it obtains relating to you, including your IP address, name, mailing address, email address and use of the Web Site, for its internal business and marketing purposes and may disclose the information to third parties for such purposes. In addition, FEP Search Group reserves the right to comply, in its sole discretion, with legal requirements or requests relating to your use of the Site or its services or information you provide while using the Site or its services or which is provided to you or otherwise gathered by FEP Search Group with respect to such use.

  1. General.

FEP Search Group is based in Oakville, Ontario. The Company makes no claims that the Content is appropriate or may be downloaded outside of Canada or the United States. Access to the Content may not be legal by certain persons or in certain countries. If you access FEP Search Group from outside of Canada or the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These Terms and Conditions are governed by the internal substantive laws of the Province of Georgia, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts in Toronto, Ontario. If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in a particular “Legal Notice,” or Software License or material on particular Web pages, this Agreement constitutes the entire Agreement between you and FEP Search Group with respect to the use of the Site. You understand and agree that, due to the nature of these Terms and Conditions, in addition to money damages, FEP Search Group will be entitled to equitable relief upon a breach of these Terms and Conditions by you.
